Litien Labs (Pty) Ltd trading as Litien Optical Lab

These Terms of Service ("Terms") govern your access to and use of the platform operated by Litien Labs (Pty) Ltd, trading as Litien Optical Lab. By accessing the platform, registering an account, or placing an order, you agree to be bound by these Terms in full. These Terms are governed by the laws of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
These Terms are between: Litien Labs (Pty) Ltd t/a Litien Optical Lab, 82 Hans Van Rensburg Str, Suite 3, Hartenbosch, Polokwane Central ("Service Provider"); and the registered client organisation accessing the platform ("Client"). The platform is intended exclusively for registered optometry practices and authorised business representatives — not individual consumers.
We provide: Lens Surfacing (precision lens shaping); Lens Cutting (accurate edging and cutting to frame specifications); Lens Fitting (alignment and fitting to frame specifications); and Quality Finishing (multi-point quality checks prior to dispatch). We reserve the right to modify or discontinue services at any time.
4.1 Registration: You warrant that you are authorised to represent your practice, that all registration information is accurate, and that you will keep it updated.
4.2 Credentials: You are solely responsible for the confidentiality of your credentials. Notify us immediately of any unauthorised account access at admin@litienlabs.co.za.
4.3 Termination: Either party may terminate the account at any time. We may suspend or terminate your account without notice for breach of these Terms, fraudulent use, or as required by law. Your access ceases immediately upon termination.
5.1 Orders are subject to acceptance by Litien Labs confirmed in writing. We reserve the right to decline or defer orders.
5.2 Quotations are valid for 14 days unless otherwise stated and are subject to change based on material costs or exchange rates.
5.3 The Client bears full responsibility for the accuracy of all prescription and frame specifications submitted. Litien Labs is not liable for errors arising from inaccurate client specifications.
Invoices are payable within 30 days of invoice date unless otherwise agreed. Interest may be charged on overdue amounts at the applicable legal rate. Non-payment may result in suspension of services and account access.
7.1 All platform content is the intellectual property of Litien Labs or its licensors. No licence is granted beyond what is expressly permitted in these Terms.
7.2 You may not copy, reproduce, or scrape any platform content without written consent.
7.3 You retain ownership of data you upload. You grant Litien Labs a non-exclusive licence to use it solely to deliver our services.
8.1 The platform is provided "as is" without warranties of any kind to the extent permitted by law.
8.2 Our total liability shall not exceed the amount paid by you to Litien Labs in the 3 months preceding the claim.
8.3 We are not liable for indirect, consequential, or punitive damages; loss of revenue or data; errors from inaccurate client specifications; or events beyond our reasonable control including load shedding or network outages.
You must not use the platform unlawfully, send spam, upload malicious code, attempt unauthorised access, or impersonate any person or entity.
We are not responsible for the content or practices of third-party services integrated with or linked from our platform.
Electronic communications via the platform are valid and binding. Acceptance of these Terms via account registration constitutes a valid electronic signature under ECTA.
These Terms are governed by South African law. Disputes are subject to the exclusive jurisdiction of the High Court of Limpopo, Polokwane Division. Parties agree to first attempt resolution through good faith negotiation.
We may amend these Terms at any time by posting updated Terms on the platform. Continued use constitutes acceptance.
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between the parties.
